Gain Social Media will provide the services to the client as outlined on the Gain Social Media Website (www.gainsocialmedia.co.uk)
Gain Social Media will provide services to client in accordance with Gain Social Media's standard policies and procedures. Gain Social Media reserves the right to reject clients for any reason, at Gain Social Media's sole discretion. Gain Social Media will be responsible for all aspects of providing the services.
You agree that upon purchasing our service, that you clearly understand and agree what you are purchasing and will not file a fraudulent dispute via PayPal.
All fees for services provided to client are due and payable in full, in advance of provision of services. A valid cars for monthly payment of fees shall remain securely on PayPal to cover monthly recurring charges for service. Plans and packages can be downgraded or cancelled at any stage before the clients next billing date, but not after if payment fails. All cancellations must be submitted through our website 'Manage Your Subscription' link which is located in the website footer. Upon cancelling your Gain Social Media subscription, the service will continue until the end of the paid billing period.
Initial charges for the service will be paid in advance of service. Thereafter, Gain Social Media will attempt to charge client through PayPal on the monthly anniversary date of the client first ordering our service. Charges not paid by the due date for any reason will result in a suspension of services until full payment is received. Suspension of services for non-payment will result in a proration of fees.
Except in the case of a material breach of this agreement by Gain Social Media, Gain Social Media does not issue refunds of any fees for any reason. A 14-Day money back guarantee is available only to those clients that sign up online using our secure checkout, and once the 14th day after payment of the first month is reached, no refund will be given under any circumstance.
Cancelling the service will terminate any further payments , however no refunds will be issued for previous payments.
Gain Social Media expressly disclaims any and all warranties regarding or related to this agreement, the services or any materials or assistance provided to client, express or implied, including without limitation the warranties of merchantability, course of performance or dealing, trade practice, title, non-infringement, and fitness for a particular purpose.
We make no warranty that:
Clients will indemnify and hold harmless Gain Social Media and it customers, suppliers, directors, officers, agents and employees from and against any and all losses, costs, damages, liabilities and expenses (including, without limitation, reasonable attorneys' fees) arising out of or relating to any breach by clients of any of the terms of this agreement.
In no event shall we be liable for any incidental, indirect or consequential not be damages of any kind, including without limitation, those resulting from loss of use, data or profits arising out of or in connection with the use of this site. Gain Social Media LTD, shall not be liable to client or any entity or person claiming through or under client for any loss of profit or income or the indirect consequential, incidental, or special damages, whether in an action for contract or tort, in connection with this agreement, even if Gain Social Media had been advised of the possibility of such damages. In not event shall Gain Social Media's liability to client hereunder exceed the amount paid to Gain Social Media by client for the previous one (1) month of services. This limit is cumulative and the existence of more than one claim will not enlarge the limit. Client acknowledges that these limitations of liability are an essential element of the bargain between the parties and their absence the terms and conditions of this agreement would be substantially different. In the event of the clients social media accounts/pages being hacked or deleted Gain Social Media will not be held accountable in any circumstance, and no refund will be issued under any circumstance.
This agreement shall be governed by and interpreted in accordance with the laws of the United Kingdom without regards to its rules pertaining to conflict of laws. It is your sole responsibility to comply with Instagram rules and any legislation that you are subject to. We are not responsible for your actions and their consequences. We are not to blame if your Instagram account is banned for any reason. You use Gain Social Media at your own risk.
The expected amount of followers, likes and comments is not guaranteed to you in any way. It all depends on the quality of your content.
